Paris Court convicted Google CEO Eric Scmidt of defamation...



 A Paris court has convicted US search engine giant Google and its chief executive Eric Schmidt of defamation over results from its "suggest" function, a French legal affairs website has revealed.



The new function, which suggests options as you type in a word, brought up the words "rapist" and "satanist" when the plaintiff's name was typed into the search engine, legalis.net reported.



The court ordered Google to make a symbolic payment of one euro in damages and take measures to ensure they could be no repeat of the offence.



The plaintiff in this case had been convicted on appeal to a three-year jail sentence for corruption of a minor, a conviction that was not yet definitive, when he discovered the results on entering his name in a Google search.



The court concluded that the search engine's linking his name to such words was defamatory.



The court ruled that Google had not showed its good faith in the matter and ordered it to pay 5,000 euros towards the plaintiff's costs.



A Google spokesman told AFP by email that they would be appealing the ruling.



The statement said that the Google Suggest function simply reflected the most common terms used in the past with words entered, so it was not Google itself that was making the suggestions.

Australia's first Saint Mary MacKillop 'exposed a  paedophile priest and was  excommunicated earleir in her life...



SYDNEY (AFP) – The late nun who is soon to become Australia's first Catholic saint was briefly excommunicated by the church in part because she exposed a paedophile priest, a new documentary claims.



Mary MacKillop, who will be canonised by Pope Benedict XVI next month, is known as a tireless educator and founder of the Sisters of Saint Joseph of the Sacred Heart order of nuns which ventured into remote outback areas.



But a documentary to be screened on national broadcaster ABC will paint her as a woman who also spoke up to church authorities about allegations of child molestation by priests, reports said Saturday.



"The story of the excommunication amounts to this: that some priests had been uncovered for being involved in the sexual abuse of children," Father Paul Gardiner, a campaigner for MacKillop's sainthood told the documentary makers.



MacKillop and her nuns told their superiors and severe action was taken, including sending one priest back to Ireland, and this so enraged other priests that they swore to take revenge against MacKillop's order, he said.



Part of this revenge included encouraging the then Bishop of Adelaide Laurence Shiel to excommunicate MacKillop, something he duly did in 1871.



"She (MacKillop) submitted to a farcical ceremony where the Bishop had... lost it," Gardiner told the documentary, which screens on October 10. "He was being manipulated by malicious priests."



The man sent back to Ireland continued as a priest, the documentary says.



"Were they covering up sexual abuse? Well, I suppose you could put it that way," Gardiner said. "Or priests being annoyed that somebody had uncovered it and being so angry that the destruction of the Josephites was decided upon."



From his deathbed some five months later, Shiel instructed that MacKillop be absolved and the Melbourne-born woman went on to grow her order around the country, attracting hundreds of women to her cause.



Calls for MacKillop's canonisation began shortly after her death in 1909.



The Sisters of St Joseph did not dispute the findings of the documentary.



The revelations come as the Catholic Church worldwide is faced with concerns about child sex abuse by priests.

Christchurch residents rally over 'third world' conditions - post earthquake news...




The way it really is, residents claim:



A digger demolishes buildings in Christchurch after the earthquake.Dozens of angry residents have rallied in one of Christchurch's worst earthquake-hit areas to let the world know their situation is not fixed, and they are still living in "third world" conditions.



About 100 people gathered in a badly cracked, silt-covered cul-de-sac in the suburb of Avonside today to express their frustration at still being in limbo and without basic services 18 days after the devastating 7.1 magnitude quake.



The residents, many Housing New Zealand tenants, are living in cracked and sunken homes, still managing without sewerage and drainage, uncertain about using the water, getting sick from contaminated silt that has come from underground, and worried what their futures hold.



They are upset that the message being sent to the rest of the country is that Christchurch is getting back on its feet when they feel far from it.



"You see on TV the devastation of third world countries or war. And that's what it felt like for the first week," said Angela Wasley, a resident of the cul-de-sac and rally organiser.



"It's absolutely exhausting. It feels like you have gone camping, and the campsite hasn't quite got the right utilities. We've got power.....but nothing else. Water comes and goes. So you can't wash, you can't flush the toilet."



"You don't really want to be in the area, because it feels like it has been demolished, and it feels broken. You don't want to not stay in your house because there's burglaries around."



"We've got this contaminated silt flying around everywhere which we can't wash off, and it's getting into our throats. We've had sore throats for about 10 days now."



Ms Wasley, who lives with her seven-year-old son and father, said she did not know yet whether her home would have to be demolished, and where she would go next.



The aftershocks after the big quake meant the "cracks keep widening".



Beneficiary Karron Gosney has slept in her damaged rental home in the largely deserted cul-de-sac every night since the earthquake, when most other houses are deserted.



"As much as we want the people of Canterbury to get back to normal, they have got to realise that a lot of us are living worse now than what a lot of people were day one of the quake."



"We are not a rich neighbourhood. A lot of us do not have access to bank loans or overdrafts or credit cards. So we are trying to do it out of our benefits."



Ms Gosney uses a shower at a local gym and the toilet at a local shopping centre.



"We don't all have friends and family that can put us up."



Mark Christison, of the Christchurch City Council's earthquake recovery team, said the team was working long hours and doing its best to get at least "limited services" restored to all homes.



"Typically the city renews about 4km of sewer a year in its network. The sort of damage that we are seeing from this earthquake could be anything from 20-30km to 100km. So that gives you an idea of the magnitude of the job thats in front of the recovery team.

When a former New Zealand National Party Government introduced a bill in 1999 to reform the drinking laws in NZ, and allowed a  Parliamentary  conscience vote, they did not do New Zealand society a favour. The drinking age was reduced to 18 years, off-licences were introduced and as a consequence younger drinkers were given  greater access to alcohol.

 Quite frankly it has become a disaster to society as a whole and has also affected driving on our streets and highways. Drink- driving and other driving offences have also skyrocketed as alcohol has become more accessable to younger teens and children.Youth  drunkenness in the CBD areas of our cities has become a problem for our police and a public nuisance to other citizens. And there has been a proliferation of alcohol outlets in our cities and suburbs - they have sprung up like mushrooms, and robberies and deaths have ensued from them.

So what has the Key National Party - led administration done about it? Apart from the rhetoric a big fat zero! There is now a social cost to New Zealand society. Mores lives are being lost annually as the government delays action and a further reform of our drinking laws.

The Government has allegedly  turned its back on hundreds of pages of official advice to increase the drinking age and reduce the numbers of alcohol outlets, and a claim that the refusal to lower  the drink-driving limitt  was costing an extra  33 lives and  a saving of NZ$238 million a year. These pages have been released under the Official Information Act and showed that lowering  the alcohol limit was the best possible action it could take to reduce the number of road injuries and  deaths caused by drunk drivers. It is obvious that the current approach to drink-driving will not reduce the the level of fatalities.

The government was told that data based on 300 overseas studies showed that 33 lives and 686 injuries could be prevented. A social saving of up to $238 million ayear could be made, and ACC could save an extra $95 million in claims each year.

But the government wants to sit on its heads and do more studies. Why? Because they are obviously coming under pressure from the alcohol industry lobby, despite denials from those involved. The government refuses to reduce the  blood alcohol limit (BAC) from 0.08 down to 0.05 as recommended by experts. This  National Government wants to have a further two years of research before they revisit the limit; there has been years of public discussion and official advice on the matter. They want a good range of public submissions, ministers have claimed. Like Nero they will fiddle while Rome burns - the Rome in this particular scenario being hundreds of more deaths and thousands of maimed New Zealanders, including babies and elderly people.

So let me halt my rhetoric and produce some facts for readers to consider:

What  a lower limit would do:

1/  Save up to 33 lives a year.

2/Prevent up to  686 injuries a year.

3/ Save social costs of up to $238 million a year

4/ACC would save up to $95 million in claims each year.

5/The financial gain would be 173 times the cost.

Knowing your limit:

!/ The current blood alcohol content of 0.08 of alcohol per 100 ml of blood allows a man of average height and weight to drink six standard drinks within 90 mins. For an average woman,  it allows four standard drinks.

2/ A BAC of of 0.05 would allow an average height and weight man  to drink two standard drinks in the first hour and one an hour thereafter. For an average woman it allows one standard drink an hour.

What the Governments opponents say:

Innocent people will continue to be killed on our roads by drinking drivers  while Minister Steven Joyce and his fellow National cabinet ministers say the can't yet make up their minds about lowering the alcohol limit for drivers on NZ roads.

Kiwi blogger Cameron Slater is likely to appeal his conviction and fines and costs of nearly $8000 for breaching suppression orders.



Slater was convicted of nine of the 10 charges he faced -- eight of breaching non-publication orders for several high-profile offenders and one of naming a victim in a sexual abuse case. The tenth case was thrown out.



Judge David Harvey fined Slater $750 and ordered him top pay court costs of $130 on each of the nine cases after rejecting submissions from his lawyer, Gregory Thwaite, that there was no case to answer.



He told Slater the internet allowed everyone to become a publisher but with that came an obligation to be accountable and responsible.



"The silent majority is no longer silent."



He said Slater had been using the internet to mount a political campaign to change the law regarding suppression orders and had deliberately published names knowing the suppression orders existed.



"You stepped over the line when you chose to publish names that were the subject of non-publication orders."



He said Slater set himself up on his blog site as judge and jury and knowing the non-publication order had been issued, he was willing to flout the law.



"There was no remorse, it was carefully planned and he knew exactly what he was doing."



During the hearing earlier today Judge Harvey and Mr Thwaite had a long legal debate over the validity of suppression orders.



Mr Thwaite said there was no case to answer because the suppression orders were invalid for a number of reasons. These included that Slater had not used the exact names of the accused as they appeared on court documents.



He also submitted Judge Harvey had the right to overturn another judge's suppression orders although the judge rejected that.



"I can't revisit what another judge has done.



"I can't say the order should not have been made -- not guilty".



He said if he did that he would be "bringing the entire system of justice into disrepute."



In his finding Judge Harvey said it was about whether a person breached the law using the internet.



"It is not a case about whether or not the law should allow non-publication orders. That debate must take place in another forum," he said.



Outside court Slater said he had "copped a flogging as best they can with a wet bus ticket."



He said he was not remorseful and had no regrets, but when asked if he would continue to flout the law, replied: "We'll see."



He said he had a few people who would underwrite his fines.



He said he did not qualify for legal aid because he had been charged under the Summary Proceedings Act.



His lawyer had advised him to appeal and he would discuss that with him."
 
 
This not a case of a blogger breaching the law for ethical reasons. Slater has his own agenda, whatever it may be.

Solving the puzzle of the extinction of dinosaurs in China...



In many of my posts at "The Green Planet" I have written of endangered species and climate change as well. Lets look at both subjects from another perspective - the past, in fact the distant past, about 65 million years ago. Right back to the age of the dinosaurs. But that story is being told right now in China, previously it was concentrated in America.



We have a good idea about the causes of the demise of the dinosaurs, this is to be confirmed very shortly if reports from China are accurate. Chinese scientist, Wang Haijun is reportedly certain the answer lies beneath a 300 metre ravine out in the countryside, 670 km southeast of Beijing, the capital city of China. This could be the final resting place where hundreds of dinosaurs lay huddled together in the final moments before their extinction millions of years ago.



There are fossils in that area: 15,000 odd bones from 65 million years ago in the late Cretaceous period shortly before dinosaurs became extinct on this planet. They support those well held theories of some "catastrophe" - explosions, global fires and sudden climate change.



Palaeontologist James Clark said the find is very important in understanding the reasons for the actual end of the dinosaur age.



The excavation is believed to be the largest dinosaur fossil site in the world. It is also evidence of a ground-breaking project in a country whose past governments rejected science as being part of the elite in their society. As the construction boom has swept China in recent years relics are being found that are causing history to be rewritten in China.



For decades most of the important research on dinosaurs centred around the USA - particularly in Utah and Montana. But attention has now moved to China with the most important discoveries in Zhuchang and other major sites.



During th 1966-76 cultural revolution scientists and other intellectuals were banished to the countryside, research institutions were closed and relics destroyed. But now modern China is pouring billions of dollars into archaeological projects - historical, ecological and palaetology - China has really become interestd in its very deep past.



Last March, 2009, a new fossil was discovered which indicated many dinosaurs actually had a featherlike fuzz, indicating a closer relationship between dinosaurs and birds. In inner Mongolia a whole herd of ostrich-like dinosaurs were excavated - giving researchers further insight into how the creatures grew up. There is undoubtably a treasure-trove of relics waiting to be found in China.



Researchers believe dinosaurs were killed and made extinct after a volcanic eruption, or perhaps more likely from a meteor impact, followed by flashfloods, landslides or a tsunami, that swept them all away. It is difficult to understand though why there are so many relics in one particular place. So very reminiscent of elephant graves in Africa where aging and dying elephants move together in their final days.

LIQUEFACTION:  A new word in our vocabluary - when solid ground is shaken to mush...







A sand volcano after the Christchurch earthquake. Large tracts of silty, low-lying land compounded the effects of Saturday's earthquake in Canterbury, as whole streets were transformed from firm land to sludge.



In what's known as liquefaction, Christchurch's sandy soil was shaken violently, causing water to rise through its pores. Scientists compared it to jumping on wet sand at the beach - it soon turns to a murky soup.



Professor Michael Pender from the University of Auckland geology department said the Canterbury quake was one of the most significant cases of liquefaction in New Zealand history.



He said the process could affect any town or city near a river, estuary or coastline. Auckland's waterfront, built on reclaimed land from the Ferry Building up to Shortland St, would be very vulnerable to large tremors.



Coastal developments which encroached on sand dunes, such as Mt Maunganui and some North Shore beaches, were also susceptible during a major earthquake.



Large sections of Christchurch were built on soft sediments which remained saturated after a wet winter.




Roads, bridges and pipe infrastructure have been unsettled by the water squirting up through the soil during the 7.1 magnitude tremor.



As many as nine out of 10 homes on the city's flat have been damaged by the quicksand-like effect. Much of this damage was superficial rather than structural. But in Bexley, a 5-year-old subdivision near New Brighton, at least 100 new homes were left uninhabitable after silt, sewage and grey sludge cracked the road and squeezed through floorboards.



The worst-affected areas were coastal spots such as New Brighton, and suburbs that skirted the lower reaches of the Avon and Heathcote Rivers, in particular Dallington.



Homes in Kaiapoi, near the Waimakariri River, were also reported to have sunk into the soil.



Geologists said that when rising water was concentrated into small cracks it could create sand volcanoes - mounds of sand that pushed up to the surface, as seen on the streets of Avonside and Linwood.



Professor Pender was surprised that some new developments were susceptible to major damage from underground water.



"You'd expect the engineers doing the site investigation to realise that there is this loose sand present and do some remedial work before they built foundations."



New Zealand Society for Earthquake Engineering spokesman Win Clark said most of Christchurch's structures performed well under the stress of the quake. "The buildings responded as expected - most damage was to unreinforced masonry and buildings built before World War II."



I understand this phenomenon has been experienced before in California, for instance. This has encouraged scientists from the US to comever and investigate.

You might say that the Christchurch, New Zealand, earthquake, of 7.1 on the Richter Scale, that occurred at 4-35am last Sunday morning, Pacific time, is the Kiwi Hurricane Katrina. Why do I say that, you might ask? It is not the devastation, because the Christchurch earthquake is confined to an area within the city and its environs, and obviously does not compare to the widespread and intensive damage caused by the American hurricane.



Christchurch City could be a bombsite because of the comparative damage to homes, buildings and infastructure. Probably 80% of these have been affected to some degree. The earthquake is not yet over because of the continuing after-shocks; they total close to 200 already and could continue for days or even weeks. A number have been recorded in the range of up to 5.4 on the Richter Scale Christchurch residents are stressed out and becoming traumatised, especially the young and elderly.



Residents cannot assess the real damage to their propertiess because of the continuing after-shocks which are still affecting the damage. But neighbours, families and friemds have assisted each other, especially the elderly and those living alone.



It is the comparative damage within the confines of this city of 400,000 and its surrounding districts, that draws my comparison. Over a hundred unstable buildings are believed to be in danger of being condemned; two protected buildings were condemned today and will be demolished — one traces its origins back to about 1877. A majority of homes in the suburb of Bexley, for instance, are in danger of being condemned because of the nature of the ground they are built on. The suburb is a drained swamp and perhaps its origins have come back to haunt the burghers of Christchurch.



Many brick chimneys and concrete facades have already been knocked down in many parts of the city. Buiding inspections have been carried out, as have inspections of schools in area. Schools will not reopen this week. Power has been restored to about 80% of residents. Water and sewerage has progressively been restored as well.



The northern township of Kaiapoi, about twenty minutes by road, was particularly devastated with broken sewer mains and water pipes. Many expensive homes in this area will have to be demolished. Many streets and roads in Christchurch City and the Canterbury region have also been severley damaged. Other infastructure has been severly damaged as well.



There have been no deaths caused by injury, though two middle aged men in their fifties are in hospital because of injuries received in the initial earthquake — one being hit on the head by a falling chimney and still on the critical list in ICU, the other severely cut by glass is in a comfortable condition. One person died of a heart attack during the earthquake. There are many minor injuries that have not yet been collated.



The government moved very quickly on Sunday supporting the Civil Defence, Christchurch City Council and the police on Sunday — the prime minister and some of his ministers arrived very early to assess the situation. Welfare centres were set up for the homeless and those who didn't wish to return to their homes. Police secured the CBD on Sunday and were relieved by eighty soldiers from the nearby Burnham Army camp on Monday morning.



As there are so many damaged business premises, many people are unable to go to work this week and earn a living — the Government will pay a subsidy of NZ$350.00 per worker in immediate assistance for the first four weeks to businesses employing less than twenty employees.



Damage to historic buildings, including the historic and iconic Christchurch Cathedral, are of great concern. Christchurch may never be the same again.



As I wrote above, the after shocks continue and more damage is expected in coming days. Some of that damage may be hard to bear and accept. Que sera sera!



The faultline that was responsible for this earthquake had lain idle for 16,000 years and nobody knew about it. At least the cause is now known.



Earthquake Christchurch is indeed the kiwi equivalent of Hurricane Katrina, but there is a lot more to write about in coming days, months and years as New Zealand's second largest city is repaired and rebuilt. This is but an early chapter in the book of Christchurch's future. Cantabrians are like the rest of New Zealanders, tough, resilient and caring to a fault at times.



That indomitable spirit so evident in Canterbury sporting teams over many decades is so very evident in city and country township communities right now. The future looks bright amid the gloom of the present.

Understanding the massive 7.0 Christchurch Earthquake...



The September 3, 2010 South Island, New Zealand earthquake occurred as a result of strike-slip faulting within the crust of the Pacific plate, near the eastern foothills of the Southern Alps at the western edge of the Canterbury Plains.

The earthquake struck approximately 50 km to the west-northwest of Christchurch, the largest population center in the region, and about 80-90 km to the south and east of the current expression of the Australia:Pacific plate boundary through the island (the Alpine and Hope Faults).



The earthquake, though removed from the plate boundary itself, likely reflects right-lateral motion on one of a number of regional faults related to the overall relative motion of these plates and may be related to the overall southern propagation of the Marlborough fault system in recent geologic time.



Today’s earthquake occurred approximately 50 km to the southeast of a M7.1, surface-rupturing event in Authur’s Pass, on March 9th, 1929, which caused 17 fatalities. More recently, two earthquakes of M6.7 and M5.9 occurred in June 1994 approximately 40 km to the northwest of today’s event, but did not cause any known fatalities or significant damage.

Gods not smiling on New Zealand's South Island - nine killed in small plane crash at Fox Glacier...



The death toll in a plane crash at Fox Glacier this afternoon has been upgraded to 9; the plane burst in to flames after take-off



The death toll from the Fox Glacier plane crash been been upgraded to nine. Police say they are the pilot and eight passengers.



People from the township report seeing a plume of smoke rising into the sky from the local airstrip.



The crash occurred just before 1.30 this afternoon. Some reports say it burst into flames after take-off.



Locals believe it may have been a sky diving flight. St John Ambulance has not transported anyone from the scene, which indicates there may be no survivors

Massive earthquake hits Christchurch, New Zealand, at 4-30am this morning...



Massive earthquake of 7.1 on the Richter scale  hits Christchurch, New Zealand,  and environs at about 4-30 am this morning. Continuing after shocks. No deaths reported,  few serious injuries, though two middle aged men are in ICU in Christchurch Hospital.. A lot of extensive damage though in central city, suburbs and in country areas. Biggest erthquake since 1931 Napier earthquake.


Rescue teams were searching for people trapped in the rubble of a major earthquake that caused extensive damage Saturday in Christchurch, New Zealand’s second-largest city.



Basic sanitation was likely to become a major health concern because numerous sewer and water lines were damaged across the city, Civil Defense officials said. About 1,000 residents of two suburbs were put on alert to evacuate their homes as widespread damage to sewer pipes threatened major flooding.



Two men were seriously injured and scores of other people suffered less serious injuries in the aftermath of the quake, which registered 7.0 on the Richter scale. It struck at 4:35 a.m. (1:35 p.m. Friday ET), the U.S. Geological Survey said in Washington.



The timing of the quake probably saved many lives, Civil Defense authorities said, because most people were braced in their beds and not packed into the older commercial buildings that suffered the brunt of the damage.



The Pacific Tsunami Warning Center said there was no danger of a tsunami.





Mike Bowden, a spokesman for the Christchurch fire service, told The Press newspaper of Christchurch that an unknown number of people were trapped in their homes and other buildings by falling chimneys, jammed doors and blocked entrances. He said emergency services were being flooded with calls but that they could respond only to “cases of life and death” because of widespread damage to roads and bridges.

Why the New Zealand quake is no Haiti

..Civil Defense officials declared a state of civil emergency shortly after 9:30 a.m. Christchurch Airport was closed, and rail service was shut down across the South Island. Several major bridges were impassable.



Christchurch authorities reported “substantial infrastructure damage” to bridges and utilities, particularly sewer and water facilities, and said many other buildings had been damaged. Mayor Bob Parker said basic sanitation was likely to become a major health concern.
